As rumors began to circulate that Apple was purchasing Beats Electronics for $3.2 billion everyone from music industry executives to stock market analysts all asked the same simple question – why? The lucrative deal makes perfect sense from Beats perspective, but what does Apple see in the high-end headphone manufacturer that made them spend so much money to acquire the company.

Speculation has centered on two possible reasons, both of which are probably accurate. The first hypothesis is that since Apple already heavily promotes Beats products through their retail stores, they may as well make them a part of the family and keep all the profits. The second theory is that Apple is hoping Beats streaming subscription service can help them with their own streaming music offerings.

With digital music sales first plateauing and now declining, Apple may be predicting that more consumers are wanting to stream their music rather than purchase it. We discuss Apple’s big purchase and provide in-depth analysis on what it means for the company and the state of the music business.

The concept that all data sent via the Internet should be treated equally has allowed services such as YouTube and Netflix to develop and prosper on a level playing field. However a new proposal from the Federal Communications Commission would effectively kill net neutrality by allowing companies to pay for faster access. Will the public revolt in mass protest or will big business ultimately prevail?

A similar question is being asked as the United States Supreme Court heard oral arguments over whether Aereo infringes on broadcaster’s copyright by retransmitting over-the-air television signals via the Internet, or if the company’s services are legal under current law. The future of television may hinge on the answer.

There seems to be no dispute over the state of opera these days as many regional companies are suffering from a number of problems, not the least of which is declining ticket sales. Most recently the San Diego Opera announced it would be shutting down after running out of money.

Showbiz Sandbox 227: The Oscars Attract Big Business, Big Ratings and Big Money

If you weren’t surprised by any of the winners at this year’s Oscar ceremony, you may have Oscar prognosticators like Anne Thompson to blame. Indiewire’s editor-at-large was at the big show and joins us to discuss the telecast, the show, and all the money and effort poured into the annual awards season. Thompson also fills us in on her new book “The $11 Billion Year: From Sundance to the Oscars, an Inside Look at the Changing Hollywood System“.

The business side of the film industry isn’t the only aspect of movies that is evolving. The sound accompanying new releases is getting a few enhancements thanks to immersive 3D audio. This has created an industry battle over audio formats.

Speaking of disputes, 19 Recordings, the music label responsible for “American Idol”, is once again suing their partner Sony. This time the argument is over the issue of whether digital tracks are sold or licensed to buyers. There is a huge difference in the royalty paid for each.

Showbiz Sandbox 213: Has Thor Brought The Hammer Down On 3D Movies?

There is no disputing the financial success of “Thor: The Dark World”, a sequel in the franchise based on the Marvel Comics superhero. What’s less clear is what the film’s box office grosses say about the adoption of 3D. During opening weekend 700 2D screens in North America accounted for 60% of tickets sales, as opposed to the 40% earned by 3,100 3D screens. Is this yet another sign audiences have given up on 3D movies?

Netflix doesn’t care how you see a superhero movie, so long as you’re watching it through their service. Last week the on-demand video powerhouse cut a deal with Disney to produce four new original series based on Marvel superheroes, all of which will lead up to a crossover miniseries.

As if competing with Netflix wasn’t bad enough, television broadcasters are still figuring out how to deal with DVRs and the growing number of audiences who time shift their content. One major broadcast network is pushing for advertisers to pay for increased viewership on DVRs for up to seven days after a show originally airs.

Showbiz Sandbox 211: Why Movie Studios Are Playing Musical Chairs With Release Dates

There was a time if a Hollywood studio pushed back the release date for one of its eagerly anticipated titles it signaled the movie might be in trouble. If there was ever a sign that such stigmas no longer apply when delaying a release date, one need look no further than this year. An overly crowded and competitive awards season has meant the release dates for a number of high-end hopefuls have been wisely pushed into 2014, including “Monuments Men”, “Foxcatcher” and “Jack Ryan: Shadow Recruit”.

Distributors in China, Japan and South Korea may soon have to start worrying about release dates too. Box office is surging to record levels in Asia, thanks not to Hollywood blockbusters, but rather homegrown productions.

If it were up to consumer electronics manufacturers, we’d all be watching movies at home on our new 4K Ultra HD televisions. Broadcasters, burned by the original conversion to HD and a string of 3D experiments, want to know who is going to foot the bill this time around.

Showbiz Sandbox 203: Star Trek Blu-Ray Leaves Frustrated Fans Lost In Space

In what seems to be an attempt to bolster sagging DVD and Blu-ray sales Hollywood studios have begun offering “retailer exclusives” on releases of their hit titles. “Star Trek Into Darkness” is the latest example of how different versions of a movie are being paired with varying sets of special features based on which store the disc is being sold. Trekkies will have to purchase duplicate copies of the latest installment in the franchise in order to collect all the bonus material.

Singers Robin Thicke and Miley Cyrus pulled a stunt of their own which helped twerk record sales. Cyrus set tongues wagging with her racy performance that MTV Video Music Awards, but she may be laughing all the way to the bank since her on-stage gyrations have helped boost sales of her new single.

YouTube is filled with user generated videos featuring hit songs by Thicke and Cyrus. If you use these recordings in the wrong way, you could get a takedown notice for copyright infringement. One music publisher however, may have picked a copyright fight with the wrong legal scholar.

Showbiz Sandbox 192: Cannes Serves Up A True Blue Masterpiece

It’s safe to say the 2013 edition of the Cannes Film Festival did not disappoint. The jury, headed by filmmaker Steven Spielberg, awarded “Blue Is The Warmest Colour” with the Palm d’Or, the festival’s top prize. It seems fitting that a film featuring a lesbian love affair (not to mention graphic sexual scenes) should win big in a year when France legalizes gay marriage. That the film may be considered a masterpiece over time doesn’t hurt either.

In fact, there was little to complain about at this year’s Cannes Film Festival, except for maybe the rainy weather. We’ll fill you in on some of the highlights as well as discussing how Angelina Jolie’s announcement regarding her double mastectomy has caused an uproar in the medical community… in a good way.

Showbiz Sandbox 191: The Misunderstood Math Behind Movie Ticket Prices

The average cost of a movie ticket dropped to $7.94 in North America during the first quarter of 2013. That’s according to the National Association of Theatre Owners, the trade group that keeps track of such figures. Patrick Corcoran, the vice president and chief communication officer of NATO, explains how the average ticket price is calculated and the perennial complaint that such a low amount can’t possibly be correct.

Meanwhile, television networks have been working overtime putting together their schedules for next season. That also means they’ve been making public which shows didn’t make the cut, a.k.a. got canceled. Did your favorite show survive for another season, or did it go the way of series such as “Smash”, which was axed as had long been predicted.

Such bad news isn’t something the Rolling Stones have to worry about. According to the legendary rock group’s concert promoter reports that tickets to shows aren’t selling is completely untrue. In fact, tickets were priced at an exorbitant $600 on purpose to keep the secondary market at bay.

Showbiz Sandbox 188: Remembering Roger – Personal Recollections of the World’s Most Famous Film Critic

The death of film critic Roger Ebert last week after a lengthy and public battle with cancer was followed by an endless stream of heartfelt appreciations. Arguably one of the most recognized and influential movie critics in the world, few were aware of Ebert’s generosity, especially when it came to fellow critics and journalists.

David Poland of Movie City News and Anne Thompson of Indiewire join our hosts in discussing a few of the personal memories each has of Ebert from spending time with him over the years. For instance, did you know filmmaker Michael Moore credits Ebert with helping spread the word about the his first movie? Or that Ebert was an early investor in a little web startup named Google?

Meanwhile, late night television dominated the entertainment news last week as NBC officially announced they would not be renewing Jay Leno’s contract as host of the “Tonight Show” in order to bring in the younger Jimmy Fallon. The Sundance Film Festival has a reputation of programming edgy, independent films that often reflect the spirit and sentiment of the country. The festival must think the nation is in a lascivious mood since many of the films at this year’s event are rather racy.

In fact, at least three films at this year’s festival focus on pornography, including “Lovelace” a biopic of the world’s first pornstar. Whether it’s suburban lesbian mothers turning into prostitutes or two best friends having affairs with each other’s sons, Sundance has been hot and steamy.

If the number of distribution deals at this year’s festival is any indication however, Sundance is surely on the right track.
