The number of households in the United States subscribing to traditional pay television services has dropped below 50% for the first time in the two years Nielsen has been tracking such metrics. And it’s not that viewers are cutting the cable cord, they’re just watching their favorite television shows and movies on streaming services more than they are on broadcast and cable.

Meanwhile, the writers and actors’ strikes show no sign of ending. One of the big sticking points is over the use of artificial intelligence in future productions. Now a new court ruling sided with the Copyright Office and said works solely generated by AI cannot be copyrighted.

There has been countless speculation about when cinemas would reopen or if audiences would actually return once they do. As well, Hollywood studios have pushed back the release of so many titles, what new movies will even be available to show?

As the head of the film department at the research firm Omdia, and an expert in the cinema sector, David Hancock has been tracking all the data associated with the industry’s current predicament. He joins us to explain how movie theaters are reopening, what obstacles they face even if successful and why the industry may lose $35 billion in box office over the next two years due to the pandemic.

Showbiz Sandbox 404: Faith-Based Films Are Competing For the Choir’s Attention

It used to be that to promote a faith-based film release, especially one geared toward Christian audiences, all a distributor had to do was screen the film for church groups or pastors, and maybe create some study material. But once studios saw there was money in faith-based movies, they began making more of them. As Ryan Faughnder, a film business reporter for the Los Angeles Times, explains, promoting such titles in a crowded market has become a lot more difficult.

In China, regulators are cracking down on marketing agencies that use hundreds or thousands of fake accounts to promote (or bash) products, movies, personalities… almost anything really. Known as the “internet water army” or “cyber navy,” they have made it hard to gauge the public’s true sentiment about a movie, actor, etc. via social media.

MoviePass meanwhile continues to make headlines, though this time it’s for something they’re not doing. Despite claiming two weeks ago that their mobile app tracks subscriber’s every move, it turns out MoviePass doesn’t really do that and the company had to apologize

Showbiz Sandbox 401: Redbox Beats Disney At Their Own Copyright Game

In the first round of a copyright infringement lawsuit, Disney failed to win an injunction preventing the DVD rental company Redbox from selling digital copies of its films. Instead, a judge ruled that since Redbox is forced to buy retail copies of Disney films, they have the right to sell the digital copy that accompanies each disc. To make matters worse, the federal court faulted Disney for copyright misuse, making the studio vulnerable to an existing countersuit filed by Redbox.

While Disney and Redbox duke it out in court over copyright issues, the cinema-going subscription company MoviePass is suing an upstart competitor named Sinemia over patent infringement while at the same time trying to straighten out its customer service.

In China the Lunar New Year closed out by bringing in $500 million at the box office, the highest weekend tally ever recorded in a single market. In total, the country took in whopping $901 million during the Spring Festival.

Hip-hop artists lead the nominees for this year’s Grammy Awards with Jay Z and Kendrick Lamar the front runners for Album Of The Year. Steve Knopper, a contributing editor for Rolling Stone and author of several books about the music industry, joins us to explain how musicians have taken a lesson from Hollywood and begun mounting marketing campaigns to snag music’s highest honor.

Accolades for the year’s best movies have also begun to be doled out with critics groups announcing their picks. “Call Me By Your Name,” “The Florida Project,” and “Lady Bird” seem to be the big favorites as we head into awards season.

Meanwhile, allegations of sexual misconduct continue to pile up against entertainment and media personalities. Showbiz Sandbox 384: NBC Has A Big Megyn Kelly Problem

NBC forked over millions of dollars to steal Megyn Kelly away from Fox News and then realized they had nowhere to put her. First the network gave Kelly a primetime news show opposite the ratings powerhouse 60 Minutes. When that move prove disastrous NBC shoehorned Kelly into the third hour of their hit morning program, “Today,” only to see the shows ratings plummet.

Marc Berman, the editor-in-chief of Programming Insider, joins us to analyze what went wrong with bringing Kelly to NBC, why putting a former political news anchor into a morning show was a bad fit, and what the network can do to save the “Today” show before Kelly brings down ratings any further. Berman believes if NBC doesn’t act soon, they could get lapped by the likes of CBS.

Speaking of public implosion swof media fixtures, the Harvey Weinstein scandal has moved beyond the movie mogul himself to encompass a culture of sexual harassment that pervades Hollywood. We’ll discuss a plausible idea that Hollywood could take toward ending such behavior.

Showbiz Sandbox 366: Shifting TV Viewership is Affecting Ratings, Ad Sales and Future Programming Decisions

All the major television networks are preparing their dog-and-pony shows for advertisers at this year’s upfront presentations as they look to sell $9 billion worth of commercial time for the upcoming season. However with viewership continuing to become more fractured, the industry has grown concerned that falling ratings over the past year will lead to lower ad sales. Which raises the question about just how accurate audience measurement is these days.

Networks have begun taking measures to shore up potentially weaker ad sales by demanding harder bargains from production companies, owning more of their own series and making untold fortunes internationally with certain shows. They’re also dabbling more and more with live television specials including musicals such as “A Christmas Story”.

The 70th edition of the Cannes Film Festival will also begin this week, though not without some controversy over two Netflix titles screening in competition, but not in French movie theaters. This has led Cannes to create a new rule beginning in 2018 that any film selected for the festival must have a theatrical release in France.

Showbiz Sandbox 352: 2017 Academy Award Nominations Launch #OscarsSoDiverse Trend

When the 2017 Oscar nominations were announced this week the Academy of Motion Picture Arts and Sciences managed to avoid a third straight year of controversy over all-white acting nominees. Among this year’s honorees are six African American actors, setting a record for the most in a single year. Hopefully this is a sign more racially diverse films are being produced.

What the Academy did manage to overlook however, were films with huge audiences. Despite nominating nine films for Best Picture Oscars, not a single one has surpassed the $100 million mark (yet).

Meanwhile, in over in the music business, album sales have never mattered less. These days it’s all about music publishing, which can be a true goldmine. Just ask Paul McCartney who is suing Sony/ATV to regain the publishing rights to the Beatles catalogue.
