Even when times are good and profits are up, some of Hollywood’s biggest stakeholders don’t always get along. For over a year now the Writers Guild of America has been duking it out over television packaging fees with the Association of Talent Agencies, suing three of its largest members; United Talent Agency, William Morris Endeavor and Creative Artists Agency. Entertainment attorney and Hollywood Reporter contributing editor Jonathan Handel fills us in on the latest court rulings in the dispute and why things aren’t looking good for the WGA.

Meanwhile, cinema operators were already upset with Universal Pictures for releasing “Trolls World Tour” via premium video on demand, skipping a theatrical release due to the coronavirus pandemic. Now the studio announced plans to release its future movies on PVOD at the same time as they hit theaters, causing a few chains to boycott Universal’s titles. Film distribution veteran Jim Amos of Scout 53 breaks down the argument for us and tells us how he thinks it will be resolved.

Showbiz Sandbox 485: Coronavirus Is Trolling the Film Industry

The ongoing coronavirus pandemic is causing the biggest disruption the global entertainment industry has had to contend with in the modern era. In the movie business alone it has shut down cinemas, delayed film releases and halted productions in all corners of the world.

Andrew Wallenstein, co-editor-in-chief of Variety, proposed that now might be an opportune time for studios to finally reach an agreement with movie theaters on release windows. No sooner had the virtual ink dried on his piece Universal Pictures announced it would be distributing some of its current and future theatrical films via premium video on demand. It would, he suggests, be the entertainment industry equivalent of peace in the Middle East.

Wallenstein joins us to discuss this fast moving story and what the future may hold for cinemas and the film industry at large.

Showbiz Sandbox 467: Is “The Terminator” Really A Franchise Property?

When James Cameron made “The Terminator” in 1984 he probably didn’t think the movie would still be spinning off sequels 35 years later, no matter how big a hit it became. Given the disappointing box office brought in by the sixth and latest Terminator film during its opening weekend it’s not hard to wonder whether the franchise might have run its course or if it should have been a franchise at all.

One film we know for sure isn’t a franchise is Martin Scorsese’s most recent film, “The Irishman.” Made for Netflix, the movie will only be in theatres for 26 days before appearing on the streaming platform. Big movie theater chains have expressed their frustration with Netflix for not adhering to a traditional theatrical release window of 90 days, though were rumored to have offered up a shortened 60-day term instead. If true, was Netflix foolish for not accepting it?

Showbiz Sandbox 466: How Hollywood Kowtows to China

Entertainment companies are finding themselves in compromising positions when it comes to avoiding political pitfalls in China. Movie studios and media conglomerates don’t want to disrupt their bottom line by appeasing Chinese authorities while surrendering their creative freedom. The result is that companies distributing content in China find themselves censoring themselves.

“South Park,” on the other hand, chose an alternative path; directly offending the Chinese government and immediately being banned throughout the country. Even when companies do kowtow to the Chinese government, they find themselves getting into trouble at home and abroad. Just ask the producers of the animated film “Abominable,” an animated film which was banned in the country for showing a map that favored China’s disputed territorial claims.

Meanwhile, the new television season started. Not that you’d know it based on the ratings, which are down almost any way you slice them. And the clear message is this: people’s viewing habits have changed, probably forever, and it’s not going to help TV channels trying to sell eyeballs to advertisers.

Showbiz Sandbox 421: How “Grand Theft Auto” Got Its Groove On

The popular video game franchise “Grand Theft Auto” has already made over $6 billion for its publisher Rockstar. Now as the game moves online its players have listened to 75 billion minutes of music. Players can stream 18 online radio stations as they make their way through the game and even buy a nightclub to book performances by major DJ’s like Black Madonna. It’s the latest digital revenue stream for record labels and artists as sales of physical media taper off.

Meanwhile, just as the Justice Department was set to investigate whether the Paramount Decrees are still necessary, a small movie theater operator in Texas is suing the world’s largest cinema chain, AMC, claiming they colluded with studios to prevent them from getting new releases. The case proves just how hard proving antitrust allegations can be.

In the United Kingdom a movement among actors to be treated more fairly during the audition process has turned into a campaign with its own hashtag; #YesorNo. Actors simply want to know whether they have gotten a role or not after an audition. Some say being ignored entirely is worse than being rejected.

Showbiz Sandbox 414: The MoviePass Effect Is Real and Here To Stay

The film industry can say what it wants about MoviePass, and it’s said plenty, but the subscription moviegoing service has made a huge impact on the market since lowering its price to just under $10 per month. Though skeptics abound on whether the company is financially sustainable, the subscription model it has popularized is quickly becoming a standard offering. Just last week AMC Theatres, the world’s largest cinema chain, announced its own subscription plan to compete directly with MoviePass.

Meanwhile, China is realizing that its growing movie and television industry is becoming overcrowded. With tens of thousands of film and TV companies having sprung up over the past decade and hundreds of films going unreleased each year, there is a fear that the country could be experiencing a media bubble that is about to burst.

Back in the United States, celebrities are suddenly are shocked to discover that the Fox News channel is peddling in propaganda and is not so concerned with actual news. While this may have been the case since the networks inception, creatives are now threatening to walk away from business with Fox Studios. Quick, somebody tell them that Fox Studios is about to have a new owner.

Showbiz Sandbox 406: Is Live Nation Bullying the Music Industry?

The merger of concert promoter Live Nation and ticketing giant Ticketmaster was supposed to increase competition, stabilize the price of live events and lower the cost of ticketing fees. Nine years later the deal has achieved none of those results. In fact, there are now reports that the Justice Department has opened an antitrust investigation on Live Nation. Who could have ever predicted that would happen when the merger was first proposed? Oh yes, that’s right… everyone (including us)!

As the recorded music industry slowly scratches it’s way back to 2008 revenue levels, one of the companies instrumental in the upswing is looking to cash in. More specifically, investors in Spotify are looking to reap the rewards of their ownership stake in Spotify, the streaming music giant, as it goes public. That begs the question however, do record labels with a piece of the company now have an incentive to give Spotify better terms? And where does that leave artists?

Meanwhile, the MPAA announced global box office reached a record high of $40.6 billion in 2017. North America contributed $11 billion to the total, a level reached mostly through increased ticket prices since attendance was at a 23 year low.

Showbiz Sandbox 379: Springsteen and Swift Beat Scalpers and Fans Pay The Price

New technology from Ticketmaster is allowing the likes of Taylor Swift and Bruce Springsteen to combat scalpers and sell tickets to legitimate fans. But at what cost? Swift is asking concert-goers to pay $63 for a physical copy of her latest album to get better seats and the ticket prices for Springsteen’s Broadway residency top out at $850.

Maybe these prices are simply musicians trying to make up for the earnings they’ve lost in record sales over the past 15 years. According to a new report from Goldmany Sachs though, the music industry is poised for explosive, make that historic; no, make that unbelievable growth. And we don’t believe it.

Meanwhile, as the summer moviegoing season in North America end in a thud with box office plummeting to record lows, bring the shares of major movie theater chains down with them. But are ticket sales the real reason behind the stock sell off.

As the Federal Communications Commission seeks to further deregulate cable television companies and do away with net neutrality, consolidation within the industry has caused rates to increase dramatically. We’ll explain how more and more people are growing fed up with high cable bills and what they’re doing about it. Some millennials have even discovered an amazing hack to get the broadcast networks for free! And it’s totally legal!

We’ll also tell you about how some big name players are getting fed up with Hollywood’s opaque accounting system. Sylvester Stallone is suing Warner Bros. over profit participation for his 1990s hit movie Demolition Man while filmmaker Steven Soderbergh is taking the distribution of his latest movie into his own hands.

In China, “Wolf Warrior 2” has earned nearly half a billion dollars at the global box office and looks set to become the country’s highest grossing movie ever. Meanwhile, Wonder Woman is still playing strong in theatres around the world and may surpass “Spider-Man” to claim the crown as the biggest comic book movie debut in history.

Showbiz Sandbox 375: The Seedy Side of Show Business is Revealed in “Walking Dead” Lawsuit

Six years after AMC fired Frank Darabont from “The Walking Dead,” the hit TV series he created and oversaw, details about why he was axed are emerging during a lawsuit filed by the filmmaker over profit participation. Citing unprofessional and erratic behavior AMC provided profanity filled emails Darabont sent to producers and executives during his tenure as showrunner. This has lead to many in Hollywood asking whether Darabont’s behavior was out of line or if he was simply trying to defend his show?

The lawsuit itself hinges on Darabont’s deal and whether the revenue AMC earns from “The Walking Dead” is significantly lower because the network is making deals with itself at a significantly reduced cost per episode. This is not the first self-dealing lawsuit to be filed by a creative in Hollywood, but given the $280 million being sought, its outcome could affect how the business operates in the future.

Meanwhile, under pressure from the Chinese government, the Dalian Wanda Group says it will no longer seek to acquire international entertainment properties, causing AMC Theatres, one of its own subsidiaries, to publicly distance itself, and leaving Hollywood wondering if funding from China might be drying up.
