Between intellectual property theft, forced joint ventures and strict government regulation, the entertainment industry has come to learn that doing business in China is difficult at best, complicated at worst. Chris Fenton, the CEO of Media Capital Technologies, knows a thing or two about doing film industry business in China, having worked in the Middle Kingdom on various project for decades. He joins us to explain the dilemma facing Hollywood in China as well as his upcoming memoir “Feeding the Dragon.”

China is, in fact, where the coronavirus originated before it spread to other countries throughout the world. Now, movie theaters in Italy and South Korea are joining their Chinese counterparts in shutting down, hoping to prevent further spread of the virus, and leading to what could be billions in box office losses.

Meanwhile, the CEO of Disney, Bob Iger, decided to suddenly step down last week and instead take on the role of Chairman. Disney theme park head Bob Chapek will be the company’s new CEO. We cover all the reasons for the executive shuffle.

Showbiz Sandbox 480: “Parasite” Infects the Oscars With Historic Win

Though many Academy Awards pundits believed that “1917” would win the Oscar for Best Picture, the prize went to filmmaker Bong Joon-ho’s “Parasite.” Anne Thompson of Indiewire joins us to explain how the industry united behind the South Korean film, giving it four top Oscars, in a historic win; the first foreign language film to ever win the Best Picture Oscar.

Surely none of the Oscar winners will be getting a bump at the box office in China, even if they managed to get a release date. Movie theaters have been closed for the past three weeks due to a coronavirus which has completely upended which films will get into cinemas and when in a tight calendar they’ll reach audiences.

Meanwhile, the WGA overwhelmingly approved their demands for the upcoming contract talks with producers and studios. The existing contract is set to expire in the middle of this year and just about everyone in Hollywood is expecting and gearing up for another writers’ strike.

Showbiz Sandbox 479: Are Streamers Ruining Sundance?

About every five years a new group of deep-pocketed players shows up at the Sundance Film Festival and spends a small fortune acquiring a handful of films causing fear that the industry has been forever changed. This year, some of the world’s largest media and tech companies have invaded Park City, Utah and are picking up movies for amounts far in excess of what makes fiscal sense or what theatrical distributors are willing to pay.

Such companies don’t have to worry about box office results because they are more concerned with a different metric; the number of subscribers they can attract to their streaming service. Now some industry veterans are worried about whether indie distributors will be able to stay afloat with the leftover titles the streaming giants don’t gobble up.

Meanwhile, in China the film industry is down for the count with cinemas shuttered for the second week in a row due to the rapid spread of a coronavirus. Flights to and from the country have been suspended, as has all film and television production. When movie theaters finally do open for business the ripple effect on the Chinese release schedule will be felt around the world as films jockey for new playdates.

Showbiz Sandbox 477: The Recording Academy Upstages Itself During Grammy Week

Even before this year’s Grammys are handed out next Sunday the Recording Academy is making headlines, not necessarily in a good way. In a controversial move, the organization put its CEO Deborah Dugan on administrative leave after less than six months on the job, citing reports of alleged misconduct. However, this came after Dugan sent a memo to the academy’s board highlighting voting irregularities, financial mismanagement, exorbitant legal bills as well as conflicts of interest with the organization’s board members, executive committee and outside lawyers.

It will take some time to sort out what is actually going on within the Recording Academy’s executive ranks, though we should know who takes home the Album of the Year Grammy by next week. If the academy plays it safe, it just might be Vampire Weekend, but we think Lizzo should be a frontrunner.

Meanwhile, Chinese New Year is upon us, the biggest movie-going week in the Middle Kingdom. As usual the country has blacked out Hollywood film releases to help bolster attendance of homegrown movies. Yet this may not even be necessary since lately domestic titles are doing better than imported content.

Showbiz Sandbox 470: The End of the Paramount Consent Decree

The Department of Justice has announced their intention to jettison the Paramount Consent Decree, the agreement that ended the studio system and under which the film industry has operated for the past 70 years. What will this mean for movie theater operators moving forward? Now that studios have become big media conglomerates will they behave anti-competitively?

Speaking of agreements, more mid-level talent agencies have signed the Writers Guild of America’s code of conduct. In the process, these agencies have gotten the WGA to agree not to enforce the ban on television packaging until one of four major firms signs on.

Meanwhile, the Thanksgiving holiday weekend was once again a time for audiences to return to cinemas en masse. However this year instead of going to see the latest blockbuster sequel, moviegoers actually sought out original films.

Showbiz Sandbox 469: Hollywood Unions Set For Fight Over Streaming Residual Payments

As television networks turn from linear broadcast methods to consumer streaming platforms a brewing battle over residual payments has the potential to spark a dual union strike in the middle of next year. Jonathan Handel, an entertainment attorney and a contributing editor at The Hollywood Reporter, joins us to discuss how the lack of data coming from streaming giants could lead to a standoff between major guilds and producers.

Indeed, in mid-2020 the master contacts between the Alliance of Motion Picture and Television Producers and the Directors Guild of America, The Writers Guild of America and SAG-AFTRA are set to expire. By now negotiations on new contracts would be well underway. Instead talks have stalled as unions try to revise the formulas used by streamers to make residual payments to their members. Given the timing, it’s a perfect storm for a potential massive industry work-stoppage.

Meanwhile, the Broadway musical “Tootsie” is closing long before it recoups its production costs. Michael Riedel of the New York Post has a host of reasons for why this critic’s darling didn’t click, however only one of them makes sense; the show’s music wasn’t all that great.

Showbiz Sandbox 466: How Hollywood Kowtows to China

Entertainment companies are finding themselves in compromising positions when it comes to avoiding political pitfalls in China. Movie studios and media conglomerates don’t want to disrupt their bottom line by appeasing Chinese authorities while surrendering their creative freedom. The result is that companies distributing content in China find themselves censoring themselves.

“South Park,” on the other hand, chose an alternative path; directly offending the Chinese government and immediately being banned throughout the country. Even when companies do kowtow to the Chinese government, they find themselves getting into trouble at home and abroad. Just ask the producers of the animated film “Abominable,” an animated film which was banned in the country for showing a map that favored China’s disputed territorial claims.

Meanwhile, the new television season started. Not that you’d know it based on the ratings, which are down almost any way you slice them. And the clear message is this: people’s viewing habits have changed, probably forever, and it’s not going to help TV channels trying to sell eyeballs to advertisers.

Showbiz Sandbox 464: Warner Bros. Gets the Last Laugh With “Joker”

After winning the top prize at the Venice Film Festival last month, “Joker” shattered October box office records around the world. This was despite mixed critical reviews and concerns about violence that led to heightened security at movie theaters. The question remains whether the movie will be too dark for Oscar voters come awards season.

The box office in China also made headlines over the past week as the country celebrated National Day by heading to the movies. China’s biggest release for the holiday week even made it onto the North American box office charts.

Meanwhile, one of Hollywood’s biggest talent agencies was hoping to raise a lot of money by going public and ultimately change how agents do business. However, Endeavor wound up pulling its initial public offering at the last minute as market makers began raising doubts.

Showbiz Sandbox 462: Netflix and Amazon Take Advantage of Fall Film Festivals

Though the Cannes Film Festival avoids programming movies from streamers like Netflix and Amazon, internationally renowned festivals in Venice, Telluride, Toronto and New York embrace them. And no wonder. As Anne Thompson of Indiewire tells us, the streamers used the fall film festival circuit to premiere some of the year’s most award-worthy movies.

Just back from Toronto and Telluride (and on her way to the New York Film Festival), Thompson fills us in on what new releases movie lovers should look forward to as we kick off awards season. She explains how making a big splash at such festivals can turn a middling movie into a hit collecting both big box office and plenty of kudos. Yes, we’re looking at you, Hustlers.

Meanwhile, with the imminent launch of their own streaming service, Disney wants to rewrite the rules — or at least the contracts — on how the profits from hit television shows gets shared, or as the company would prefer it, not shared. Showbiz Sandbox 461: A Crazy Example of Hollywood’s Gender Pay Gap

Pay disparity based on gender is not a new thing in the entertainment industry, especially in the movie business. History is rife with examples where leading men got paid multiples more than their leading ladies. However, gender pay gaps behind the camera aren’t often publicized. That wasn’t the case when Adele Lim, the co-writer of “Crazy Rich Asians” found out how much more her male co-writer was being paid for the sequels, she went public.

The good news according to a new study is that in front of the camera Hollywood is becoming more diverse. Women and people of color are being cast more than ever with 39 out of the top 100 films in 2018 featuring a female lead. Last year also marked a 12-year high for minorities being given speaking roles.

Meanwhile, advertisers and television networks are concerning themselves with a different set of numbers; viewership ratings. For the first time ever, Nielsen is counting all the people who watch TV in bars, airports and hotel lounges. Ratings will surely go up for some big categories such as sports. But will ad rates go up too?
