Showbiz Sandbox 241: YouTube Gets Tough With Indie Record Labels

As YouTube gets set to launch its own streaming music service the company is updating existing partnership contacts with record companies. While all of the major labels have signed on, some independent labels are balking at what they consider unfair terms. Now, YouTube is threatening to block the content of any label refusing to enter into its new licensing contracts, a move that is proving hugely controversial and divisive throughout the tech and entertainment industries.

Speaking of contracts, when it came to negotiating the deal for his latest film “Boyhood”, director Richard Linklater gave up a large part of his usual salary to assure he would actually own a piece of the movie it took him 12 years to complete. Will more filmmakers decide to forfeit their upfront fees and begin taking ownership stakes in their projects, or is Linklater’s move a one-off?

Musician Jack White probably isn’t setting any trends either, at least not for vinyl records. His new album sold 40,000 on vinyl during its first week of release though that can probably be attributed to all the nifty extras White included on the vinyl version such as hidden tracks and alternate versions rather than any ongoing interest in the analogue medium.

Showbiz Sandbox 171: Cost Of Sports Could Be Cable’s Unbundling

The rights to broadcast Major League Baseball games through 2021 were recently scooped up by ESPN for a cool $5.6 billion. That’s nothing compared to the $15.2 billion the network will be paying the NFL for “Monday Night Football” over the next eight years. Now News Corp. has coughed up billions for a stake in the New York Yankees network and are on the verge of paying a rumored $6 billion for the rights to air Los Angeles Dodger baseball games for 25-years. Some cable operators are now saying the skyrocketing costs of sports programming is out of control and unrealistic.

Since we’re talking about billions of dollars, we may as well mention Sony Pictures. Thanks to films such as “The Amazing Spider-Man” and “Skyfall” the studio has taken in more than $4 billion worldwide this year at the box office. Lionsgate isn’t doing too bad either, earning $1 billion with releases such as “Hunger Games” and “Twilight Saga: Breaking Dawn”.

In fact, the North American box office is on pace to set a new record this year, much like the grosses recorded over the Thanksgiving holiday weekend. The $290 million was a new high for the four day period.

Of course, we also cover all the big entertainment headlines from the past two weeks including the ongoing sexual abuse scandal rocking Sesame Street, the death of actor Larry Hagman and NBC’s big win during the November sweeps.

Showbiz Sandbox 170: Why Star Wars Is Better Off Without George Lucas

Two weeks ago Disney surprised everyone by purchasing Lucasfilm for a pricetag of $4 billion. Like the studio’s acquisition of Marvel in 2009, the move makes perfect sense since Disney can exploit the Star Wars franchise in films, television and theme parks. Given the quality of the prequels, it’s not hard to see why fans were relieved to hear George Lucas, the creator of the Star Wars universe, will have a limited role in the sequels Disney plans on releasing.

Speaking of lucrative franchises, the latest James Bond film, “Skyfall” was released to both favorable reviews and huge grosses. The twenty-third installment of the Bond series may earn over $1 billion at the international box office. And all without 3-D ticket surcharges.

Though audiences continue to reject paying a premium for 3-D movies in theaters, consumer electronic manufacturers report that the sales of 3-D capable televisions and Blu-Ray players is on the rise. However just because a TV can play 3-D content doesn’t mean people will take advantage of the technology.

Showbiz Sandbox 115: Record Industry Wages A Quiet War Over Song Rights

When the United States copyright law was revised in the mid-1970’s a little-known provision was included that lets musicians and songwriters reclaim ownership of their recordings after 35 years. Artists such as Bryan Adams, Bob Dylan, Loretta Lynn, Tom Petty and Tom Waits are set to regain control of their recordings starting in 2013 thanks to these “termination rights”. Rather than lose control of works worth millions of dollars, New York Times culture reporter Larry Rohter discusses how record labels plan to fight the provision in court.

Also picking a fight is Disney, which halted production of “The Lone Ranger” which was to star Johnny Depp and be directed by Gore Verbinski. Does pulling the plug on Jerry Bruckheimer’s latest blockbuster mean that Depp will refuse participate in another “Pirates of the Caribbean” sequel?

AMC has had its fair share of scuffles lately. After numerous disputes with the creators of their hit shows, AMC has become not only one of the most acclaimed cable networks in recent memory, but also one of the most troubled.

Showbiz Sandbox 81: Kanye West Spins His Own Hype

The week of Thanksgiving is usually slow when it comes to entertainment news, but not this year. There was a horse race at the box office as Disney’s 50th animated feature nearly toppled the seventh Harry Potter film at the box office. “Tangled” received positive reviews and earned an impressive $69 million over the four day holiday weekend.

Also bowing last week was Kanye West’s fifth studio album which is being hailed by critics as a masterpiece. But even before critics had weighed in West had jumped on popular social networking platforms to promote the release and his image. A story in the Los Angeles Times claims the hip-hop star has become a master at creating and controlling his own hype. If that’s the case, then why does West have such a terrible reputation as a troublemaker?

Also trying to promote themselves via social media was Sesame Street’s Cookie Monster. The furry blue “cookie enthusiast” is campaigning to host “Saturday Night Live” starting with a video on YouTube. Don’t laugh too hard though, since “SNL” seems to be where the Oscars are scouting for hosts. Just ask two former SNL guests James Franco and Anne Hathaway who will be co-hosting the 83rd Academy Awards.

Showbiz Sandbox 73: Handicapping This Season’s New TV Shows

With the new television season already underway our hosts debate which of the new series will get a full season order from the networks and which won’t make it to October. Will the revival of “Hawaii Five-O” make the cut? What will be the first show to get canceled? Let the arguments begin.

Oliver Stone got passing grades this week with “Wall Street: Money Never Sleeps”. The sequel to his iconic 1987 film topped the box office with just over $19 million. Of course, if Hollywood studios have their way, video-on-demand might start being included in opening weekend numbers. In an effort to supplement sagging DVD sales, the studios are planning to offer movies via premium VOD shortly after their theatrical release. At $25 per film audiences may just be willing to wait a few months.

Meanwhile, shares in Netflix soared when Blockbuster filed for bankruptcy, though the DVD-by-mail powerhouse may be facing some stiff competition as it migrates to a movie streaming business model.
