Showbiz Sandbox 469: Hollywood Unions Set For Fight Over Streaming Residual Payments

As television networks turn from linear broadcast methods to consumer streaming platforms a brewing battle over residual payments has the potential to spark a dual union strike in the middle of next year. Jonathan Handel, an entertainment attorney and a contributing editor at The Hollywood Reporter, joins us to discuss how the lack of data coming from streaming giants could lead to a standoff between major guilds and producers.

Indeed, in mid-2020 the master contacts between the Alliance of Motion Picture and Television Producers and the Directors Guild of America, The Writers Guild of America and SAG-AFTRA are set to expire. By now negotiations on new contracts would be well underway. Instead talks have stalled as unions try to revise the formulas used by streamers to make residual payments to their members. Given the timing, it’s a perfect storm for a potential massive industry work-stoppage.

Meanwhile, the Broadway musical “Tootsie” is closing long before it recoups its production costs. Michael Riedel of the New York Post has a host of reasons for why this critic’s darling didn’t click, however only one of them makes sense; the show’s music wasn’t all that great.

Showbiz Sandbox 460: Spider-Man Exits The Marvel Cinematic Universe

The big-time Hollywood divorce that has the entertainment industry buzzing this summer is the acrimonious split between Sony Pictures and Walt Disney Studios over custody of the most popular character in the Marvel Cinematic Universe; Spider-Man. The agreement that allowed Sony to loan out the character for Disney’s Avenger films was unprecedented. But after Disney asked to share in the financing and profit of future Spidey films, Sony opted out of the relationship.

The latest Spider-Man movie was one of the biggest hits of the summer, though box office for the season was actually down. One might think that’s why AMC Cinemas is planning to experiment with dynamically pricing movie tickets, but actually it’s really because they just want to charge more for popular films.

Meanwhile, streaming giants like Netflix are premiering some of their high profile movies at the biggest fall film festivals just in time to kick off awards season. They even plan to show them in cinemas before allowing them to be streamed on their platform. Now all Netflix has to do is convince cinema chains to book them.

Showbiz Sandbox 433: 2018 Was A Blockbuster Year at the Box Office

A string of big movie releases during the holidays helped the North American box office set a record in 2018, ending the year at $11.9 billion. Ticket sales also set a record in China where roughly $8.7 billion was earned. These two territories combined accounted for 48% of the $41.7 billion global box office.

However, growth in the second largest movie market in the world slowed to 9%, down from nearly 14% the year before. That’s why China ignored it’s quota on imported films at the end of 2018, allowing several Hollywood titles to be released. We’ll see if that trend continues into the new year.

In somewhat related news, a survey commissioned by the National Association of Theatre Owners showed that streaming services like Netflix do not adversely affect the frequency of moviegoing. Apparently people who watch a lot of movies at home, also like to watch movies in theaters. Go figure.

Showbiz Sandbox 432: Peak TV Just Got Peakier

When John Landgraf, head of the FX network, proclaimed we had reached a state of “peak TV” back in 2015, he predicted the 422 television shows being produced at the time would inevitably decline since there was no way for audiences to keep up. Last year however, that number rose to 495 series being produced. To put this increase in perspective, there were 182 shows on the air in 2002.

It’s safe to assume these numbers are bound to rise with new entrants into the video streaming market launching in 2019 including Disney and WarnerMedia. What’s more, the annual amount of money being spent on all this content is astonishing with the likes of Netflix and Amazon each spending $8 billion and $5 billion respectively. And that’s nothing compared to the $22 billion Disney is shelling out.

Meanwhile, the awards season is underway with all sorts of groups weighing in on their favourites, including the Los Angeles Film Critics Association, the Golden Globes and the first awards that matter: the Screen Actors Guild. Spoiler alert: “Roma” just hit a roadblock.

Showbiz Sandbox 430 – Taylor Swift Helps Fellow Artists With Her New Record Deal

When her current recording contract expired at Big Machine, Taylor Swift went looking for a new label. After a heated bidding war, Swift wound up at Universal Music landing a deal that allows her to retain control of her masters. Swift also demanded that if the label ever sold its share in Spotify that she get a cut. More importantly, she insisted on this for every single act in Universal’s roster.

This is especially notable because Swift is not a big player in music streaming, because she holds back her albums with a window to urge fans to purchase them instead. Unfortunately, the sales of physical albums, like vinyl LPs and CDs, is collapsing, causing many artists to get out of the habit of actually creating them. Instead, some big acts release a constant stream of singles, videos and live cuts since that’s how their fans listen to music these days.

Meanwhile the North American box office continues to chug along at 10% over last year’s tally, with a record breaking $12 billion in sight. That growth rate is keeping pace with the Chinese box office, which is up 11% this year, earning $8.1 billion thus far. Maybe the date for when China’s theatrical box office will surpass that of North America’s needs to be pushed back a year or two.

Showbiz Sandbox 417: On-Demand Surpasses Live TV Viewing

It seems as if we’ve been talking for a decade or more about how television viewing patterns are shifting. Audiences have eschewed live broadcasts for on-demand programming and in the United Kingdom, more households now subscribe to streaming services than traditional pay TV. Maybe that’s why niche sports like arm wrestling, archery and bull riding are all conducting their own streaming experiments.

In China, parents are requesting the government set up a ratings system for movies so they know what releases are appropriate for their children. Meanwhile, a new report claims of the 271 local movies released in China this year only 12 have made a profit.

And in the United Kingdom book sales were up last year which is good news for publishers. Unfortunately, authors didn’t see much in the way of a bump in pay. In fact, as the publishing industry’s profits rise, author’s incomes have declined to record lows.

Showbiz Sandbox 412: Canceling “Roseanne” Was A No Brainer for ABC

Never before has a major broadcast network canceled a number one rated television show, let alone done so within hours of a brewing controversy sparked by one of its stars. Yet that’s exactly what happened last week when a racist tweet from Roseanne Barr caused ABC to ax the popular reboot of her eponymous hit sitcom. What’s remarkable is not only the unprecedented nature of the move, but more so the speed at which the decision was made and carried out.

Meanwhile the Tony Awards are being held next week to honor the best new Broadway productions, however there is little suspense over who will win since it’s already seen as a foregone conclusion. That’s why we look ahead to next year’s theater season and tell you which shows we’d back as investors.

And MoviePass is once again in the news, though this time it’s not for their subscription movie ticket service but rather a film they are co-distributing in North America. Turns out they may have an indie-hit on their hands.

Showbiz Sandbox 389: The Ever-Growing List of Hollywood’s Sexual Harassment Accusations

Six weeks after allegations of sexual abuse and harassment against media mogul Harvey Weinstein were first reported by the New York Times, there seems no end to the number of Hollywood players being accused of misconduct. Kevin Spacey and Louis C.K. may be the biggest stars to have their careers upended thus far, but they won’t be the last as everyone from actor Jeffrey Tambor to talent agents to politicians and even journalists are having similar claims made against them.

The unanswered question is how the entertainment industry will implement changes to ensure sexual harassment will come to an end. Instead, there is concern of a backlash should the public grow tired of hearing about the latest offense to come out of Hollywood’s ranks.

Meanwhile, suing someone these days as become the industry’s second favorite past-time, right after wondering whose vile behavior will finally come back to haunt them. The hit TV show “Supernatural” is apparently losing money after years on the air, while director George Miller says “Mad Max: Fury Road” did not go over budget and he’s suing Warner Bros. to prove it.

Showbiz Sandbox 388: Contemplating A Fox In The Mouse House

The Walt Disney Company reported earnings for the past year fell 1% as media networks help drag down profits. With revenue from its sports network ESPN declining, the entertainment conglomerate is now looking to get even bigger through acquisitions that will bolster its streaming media service. Specifically, Disney has been eyeing key assets of 21st Century Fox’s film and television holdings.

As the media landscape shifts, becoming more fractured, so too have the ways in which content such as movies and television shows is monetized. In an age where new entrants make their money selling electronic devices (Apple) or other products (Amazon) it would appear that size matters. Thus the reason investors are bullish on a deal between Disney and Fox.

Once again we can not avoid discussing the sexual harassment allegations that have erupted in Hollywood and started to spread into other industries, even politics. With each passing week another celebrity or power player sees their life fall apart amidst accusations of misconduct. The latest is comedian Louis C.K. who says the claims against him are all true.

Showbiz Sandbox 379: Springsteen and Swift Beat Scalpers and Fans Pay The Price

New technology from Ticketmaster is allowing the likes of Taylor Swift and Bruce Springsteen to combat scalpers and sell tickets to legitimate fans. But at what cost? Swift is asking concert-goers to pay $63 for a physical copy of her latest album to get better seats and the ticket prices for Springsteen’s Broadway residency top out at $850.

Maybe these prices are simply musicians trying to make up for the earnings they’ve lost in record sales over the past 15 years. According to a new report from Goldmany Sachs though, the music industry is poised for explosive, make that historic; no, make that unbelievable growth. And we don’t believe it.

Meanwhile, as the summer moviegoing season in North America end in a thud with box office plummeting to record lows, bring the shares of major movie theater chains down with them. But are ticket sales the real reason behind the stock sell off.
